    Abstract [en]

    Abstract

    The essay highlights pros and counterarguments about the incorporation of the UN Convention on the Rights of the Child in Sweden. The pros and cons highlighted in the essay by incorporation have not been found to be crucial to the status of children's rights or even the convention. The conclusion is that incorporating the international experience of judging is not as binding as advocates and opponents state. The countries that have implemented the Convention on the Rights of the Child have not had a better situation automatically on children's rights, but they have also not been hindered or steered in the negative direction in their work to any significant extent. Incorporation is secondary to the political will to work with the Convention and children's rights; it cannot legally direct the policy if the policy does not want to be governed. However, an incorporation can become a tool in the hands of a political movement that is already convinced of the right to strengthen children's rights in accordance with the Convention on the Rights of the Child.

    Abstract [sv]

    Denna uppsats undersöker FN:s roll och antagna resolutioners påverkan på det palestinska folkets rätt till självbestämmande i Gaza och Västbanken efter Oslo-avtalen 1993. Genom att granska FN:s deltagande i fredsprocessen och dess politiska ställningstaganden i regionen, syftar studien till att ge insikter om FN:s förmåga att påverka självbestämmandet för det palestinska folket. Studien använde kvalitativ textanalys och realistisk teori för att utvärdera FN:s agerande och resolutioners effektivitet. Resultaten visade att trots FN:s resolutioner och engagemang har implementeringen av palestiniernas rätt till självbestämmande varit bristfällig och ineffektiv. Bristen på en effektiv mekanism inom FN för att genomdriva resolutioner och säkerställa efterlevnad av internationell lag har begränsat organisationens förmåga att lösa konflikten och skydda de drabbade. Genom att tillämpa realistisk teori visar studien att stater prioriterar sin överlevnad över moraliska principer och att FN strävar efter fred genom förhandlingar och konfliktlösning för att säkra ordning och säkerhet.

    This study is about the principle “Responsibility to Protect” and its implementation in several countries. The purpose of this study is to examine why the implementation of “Responsibility to Protect” has been used differently in similar situations. To limit my study I have chosen to examine two countries that have two different results on similar issues. I have chosen to study the conflict/civil war in Libya and Syria. The reason why I have chosen these countries is because these conflicts have similar causes and similar history, but how the international community responded differently and has argued various. This study will also highlight and observe the difficulties that the principle faces. For example the veto right in the united nation security council, and also the principle of sovereignty. At the end of this study I discuss the principle in general, what I think about it and how the principle “Responsibility to Protect” can be improved itself and develop to be more powerful and fulfill its purpose, to Protect civilians from genocide, crime against humanity and towards war crime.

    Abstract [en]

    The present study investigated the incorporation of the UN Convention on the Rights of the Child into Swedish law through an examination of the juridical difficulties in the state and municipalities. The study employed three methods: Qualitative content analysis, juridical method, and a semi-structured interview. The results show that the incorporation alone is not sufficient but is a project that needs continuous efforts to have thorough effects on children’s rights. As the phrasing of the Convention is vague it results in difficulties in exercising the rights, especially regarding the best interest of the child. Furthermore, the Swedish law prohibits children under 18 years old to bring an action to court in certain issues such as migration cases. Additionally, as Sweden has not ratified the third optional protocol of the Convention regarding the right to seek justice from the Committee on the Rights of the Child in case of a violation of rights on a national level, this further limits children to exercise their rights. On the municipal level, dissemination of information and knowledge regarding the Convention, cooperation between municipal bodies and the government, commitment for change, and access to adequate resources are all important tools for the implementation.

    Abstract [en]

    The child soldier problem is an escalating and growing phenomenon around the world. It is a complex issue as it involves a wide range of areas such as human rights, politics and cultures. A comprehensive legal framework is in place to protect children in armed conflicts, yet they are still being targeted, recruited and deployed in armed groups and organizations. The purpose of this study is to conduct an exhaustive examination of current international law, de lege lata, regarding child soldiers aged 15-18. The legal-dogmatic method will be used to identify the merits, but above all the shortcomings and problems of the legislation. The result shows that international law treats children differently in terms of age and when they are no longer considered child soldiers. The findings demonstrate the difficulties between the two frameworks of international humanitarian law and international human rights law in relation to child rights and protection issues. Furthermore, it has been discovered that the international law regarding child soldiers is outdated, contradictory and inconsistent, as society and warfare have changed since the adoption of the documents. The lack of legal sanctions against recruiters and enablers complicates the situation even further.

    Abstract [en]

    Ethiopia has experienced a deadly two-year-long civil war, mainly between the government of the Federal Democratic Republic of Ethiopia (FDRE) and the Tigray People's Liberation Front (TPLF). During this civil war, in addition to lethal weaponry like drones, jets, missiles, and tanks, the combatant parties and their allies used hate speech as a weapon of war. The aim of this research is to unpack the severity of hate speech disseminated during the civil war and identify its major types that could have contributed to the escalation of the war and the incitement of human rights violations. To achieve this aim, the research used the qualitative content analysis method to analyse data gathered from hate speech broadcasts during the civil war. Furthermore, it applied the propaganda model, framing theory, social identity theory, ARTICLE 19's hate speech pyramid, and the Rabat Plan of Action’s six-part threshold test theoretical and analytical frameworks to analyse the data and discuss its major findings. The research found that the most severe types of hate speech, which aimed to incite genocide, discrimination, hostility, or violence, as well as racial hatred, were disseminated during the civil war. Moreover, it revealed violations of international and Ethiopian laws regulating hate speech. Based on the analysis of empirical data, it is concluded that severe types of hate speech disseminated during the civil war had the potential to escalate the war and incite documented human rights violations.

    På fem månader har det inkommit 3389 anmälningar om barn som bevittnat våld mellan närstående. Lagen som kriminaliserar exponerandet av våld och brott inför barn heter barnfridsbrott och började att gälla den 1 juli 2021. I en undersökning som SVT presenterade 19 december 2021, framgår det att 195 av anmälningarna har lett till åtal.1Utmärkande för barn som bevittnar våld i nära relationer är att en närstående till barnet utsätter en annan närstående för våld eller brott. Detta innebär att barnet både står nära en gärningsman i anknytning och ett offer. Kombinationen av detta skadar inte endast tilliten och tryggheten hos personerna som barnet söker omsorg hos, utan leder till långsiktiga konsekvenser för barnets hälsa.2I FN konventionen om barnets rättigheter framgår det en nolltolerans av våld mot barn. Eftersom konventionen är inkorporerad in i svensk lag sedan 1 januari 20203, infaller konventionens förpliktelser den svenska staten. Ett sätt att skydda barn från att utsättas för våld är genom att införa lagstiftningsåtgärder som är förenliga med principen om barnets bästa. Utifrån ett barnrättsperspektiv kan den gällande rätten för barn som upplever våld och brott kritiseras. Detta med anledning av att rekvisitet bevittna är för snävt för att omfatta barns olika upplevelser av våld.I Sverige lever det ca 210 000 barn med våld i hemmet.4 Gemensamt för dessa barn är att de tilltar olika strategier för att handskas med våldets konsekvenser. I de fall där våldet blivit en del av vardagen, är det inte ovanligt för barn att sätta på sig hörlurar för att slippa höra mammas skrik. I utredningen till det föreslagna barnfridsbrottet resonerade regeringen kring detta. Att barns upplevelser av våld ofta är präglade av överlevnadsstrategier som gör att barn varken ser eller hör våldet. Trots detta är en förutsättning för straffbestämmelsen att barnet har bevittnat den brottsliga gärningen.

    This study is concerned with the drafting process of the 1948 Genocide Convention, specifically the deletion of the article regarding so called ”cultural genocide”. Sweden was one of the states who voted to delete the article, and this study asks the question why. Previous research on the article has concluded that the majority of the states voting to delete it were doing so to avoid being criminalized themselves due to their assimilationist policies towards minorities, and colonial governing. During negotiations Sweden explicitly referred to the Christianization of the Sami people, which further begs the question if Sweden were also acting because of those reasons. The study finds that, even though Sweden argued that cultural genocide was not as serious as the other forms of genocide, and that it was a better fit for a convention on human rights or minority protection, there is a real plausibility that the country were trying to avoid having a legally recognized genocide in its history. However, because of the vast amount of material available for interpretation of Sweden’s actions, more research is needed to make an even more certain conclusion.

    Swedens exports arms to Pakistan despite the existence of laws and conventions on what specific countries must achieve in order to meet the criteria for being exported to.

    In a realpolitik perspective, this study will deepen and investigate how the Swdish government can approve an arms export to Pakistan and how human rights are violated in Pakistan.

    In 2018, a munitions law was added and come into force. The law would include an impediment to exports to countries with a dubious democratic status or where human rights are violated.

    A determination has made that i conditions are given for the Swedish state to grant a permit for arms to exports to Pakistan that seriously violates human rights, a complete assessment has made and decisions made with meaning that the political interests priorities are valued higher than the interests of human rights.

    Abstract [en]

      Sierra Leone is a low-income country where 7.3% of its expenditure comes from the state and the rest is from charity and private expenditure, and therefore there is no official budget for mental health. Although many postcolonial countries have ratified international laws, many still have colonial discriminatory laws like ‘Lunacy Acts’ as national law, one of these countries are Sierra Leone. Sierra Leone has ratified the International Covenant on Economic, Social and Cultural Rights but hasn’t abolished ‘The Lunacy Act’ from 1902. ‘The Lunacy Act’ is a law against individuals with suspected mental health illnesses, therefore the focus of this thesis is mental health in Sierra Leone.

     Scholars believe that part of Sierra Leone's issues are due to Sierra Leone's colonial history. For that reason, this thesis has a postcolonial outlook for a deeper understanding of why 'The Lunacy Act' remains in a postcolonial Sierra Leone. To achieve that goal, a meticulous qualitative text analysis is needed. A comparison with ‘A postcolonial critique of Mental health’ will be made to help dissect the true postcolonial meaning of ‘The Lunacy Act’. Although the formal colonization is over, the ideological ones remain. This is noticeable through, for example, science. Western imperialism is not felt through physical colonialism such as borders and people, but also within cultural and political hegemony. An example of this is 'The Lunacy Act'. 

     The negative view of mental illness in postcolonial Sierra Leone persists due to the cultural hegemony. It is stronger than the political hegemony partly because the Sierra Leonean cultural hegemony cooperates with the thought system of Western psychiatry, meaning that the global south is more prone to mental illness, according to the colonial racialized system. In other words, "The Lunacy Act" is partly a tool of Western psychiatry and capitalism and that is why it has not been abolished in postcolonial Sierra Leone.

    In India, the law does not consider marital rape as a criminal offence. This means that the legal provisions do not acknowledge that a husband can be held accountable for raping his wife. The reasons for this are numerous and can be found in a range of reports from the Law Commission, Parliamentary debates, and judicial decisions. There are various reasons for this, including the desire to uphold the importance of marriage as an institution and the availability of other legal solutions. Given the ongoing debate surrounding the criminalization of marital rape in India, it is important to thoroughly examine the potential consequences of such a move. In order to achieve this goal, the current research will gather information from a diverse range of secondary sources, such as books, journals, articles, and reports that are relevant to the topic being investigated. The research will also gather primary data from respondents to obtain firsthand perspectives on this matter. This paper provides an in-depth analysis of the perspectives presented by different scholars regarding the criminalization of marital rape in India. In contrast to the responses obtained from the respondents for this study, the majority of them suggest that marital rape should not be criminalized. In addition, the paper delves into the approach taken by the Indian judiciary regarding the criminalization of marital rape. This study aims to provide valuable insights for leaders, scholars, and academics to better understand the advantages and disadvantages of criminalizing marital rape in India.

    The City of Stockholm has declared that it will be leading in the implementation of Agenda 2030. The study is based on interviews with political parties, representatives from the administration and civil society actors in the City of Stockholm. It explores how concepts within and the relation between Agenda 2030 and human rights are perceived. The results of the study are based on four themes: to leave no one behind, politics, language and practice, and partnership. A tension between human rights and Agenda 2030 is found, but also commonalities. The study shows that in local administration, Agenda 2030 and the Sustainable Development Goals are often regarded as more practical than human rights. Yet, respondents believe that human rights can strengthen Agenda 2030. Across all respondent groups, the study finds that there are expectations of Agenda 2030 breaking silos, uniting actors and offering a framework that is stable over policy shifts

    This essay is based on a case of a Swedish student with dyslexia who was denied the right to his aid during the national exam in Swedish. The purpose of the study is to shed light on the problems in how practice is interpreted and how future cases can behandled. In order to examine the current law in discrimination that dyslectics experience within the school system. The study has used the legal dogmatic method,the right as it is “de lege lata'' as well as “de lege ferenda”, as the right should be. The study has concluded that even if the student is not denied the right to a free education,the study wishes to draw attention to the fact that the student may have been exposed to discrimination based on the European Convention Art.14. What the study has discovered by analyzing the material is that the adaptations offered to the student did not compensate for the absence of the compensatory aid for the national test.

    In 2020, the Convention on the Rights of the Child was incorporated into Swedish law, with the aim that the child perspective and the best interests of the child would be reinforced in areas such as refugee law. At the same time, the temporary law (2016:752) was introduced in 2016, which limits the child's possibility of obtaining a Swedish residence permit. Using the legal dogmatic method, this study answers the purpose and aim of this thesis that is; what factors determines whether a child is allowed to stay in Sweden or not, how the best interest of the child and child-specific grounds for residence permit are interpreted in applicable law and in cases where children's asylum cases are tried in the Court of Migration, and lastly what conclusions can be drawn from these findings. The thesis achieves this by analyzing and comparing four different judgments from the Court of Migration to examine how the Convention on the Rights of the Child, the Aliens Act and the best interest of the child is applied in the different cases as well as the varying factors that makes them differ. The results in the thesis goes through the applicable law in the field and present child-specific provisions in applicable law such as in the Convention on the Rights of the Child, the Aliens Act and the Temporary law from 2016, combined with the preparatory work of the laws that contributes to how these provisions are interpreted and understood, and praxis in the form of 4 different judgements. The analysis concludes the differences in the judgements and that there are certain aspects and factors in the judgments that seem to have been crucial in the Migration Court's assessment and decision. Finally, the thesis presents the conclusions that can be drawn from these outcomes, as well as an investigation on the limitations of the principle of the best interest of the child in asylum law, which ultimately results in the child's best interests being, in principle, complex and requiring interpretation.

    Since the Supreme Court's decision of overturning Roe v. Wade’s protection of abortion in Dobbs v. Jackson Women’s Health Organization in 2022, multiple states in the U.S. has put abortion bans into effect. “Problems” are not a fixed concept but rather changeable and dependent on who is looking at it. By using Carol Bacchi’s “What’s the problem represented to be?” approach to policy analysis, the problem representations in the U.S. abortion bans and in human rights are identified and contrasted. The problem representation in the abortion bans is identified as “violations of the rights of unborn children” and the problem representation in human rights is identified as “violations of women’s equal rights.” While the problem representations are found to be opposites, they can both still be critiqued by feminist theory and arguably create inequality for women in different ways. How the problem of abortion is represented to be, and the way rights are used and argued for in the abortion bans as well as in human rights shows how they are not giving women equal rights to rights.

    Denna uppsats syftar till att undersöka hur två av barnkonventionens fyra grundläggande principer, nämligen barnets bästa och barnets rätt till delaktighet, tillämpas i asylärenden. Det ingår även i syftet att undersöka ifall det går att urskilja några mönster i bedömningen från före och efter barnkonventionens inkorporering i svensk nationell lagstiftning sedan år 2020. Materialet har omfattats av fem domstolsbeslut, relevanta delar från barnkonventionen och utlänningslagen, samt relevant tidigare forskning som kopplar an väl till uppsatsens syfte och frågeställningar. För att besvara syfte och frågeställningar har en rättsdogmatisk metod valts för att granska de fem domstolsbesluten från Migrationsöverdomstolen och Migrationsdomstolen utifrån gällande rätt. Studiens huvudsakliga resultat har visat på en diskrepans mellan lagstiftning och policydokument med avseende hur barnets bästa och barnets rätt att komma till tals tillämpas i praktiska sammanhang. En slutsats som dras är att genom att belysa frågan från ett MR-perspektiv med en rättsdogmatisk ansats, har detta bidragit till att belysa diskrepansen mellan mer abstrakta lagar och dess tillämpning inom asylärenden.

    Abstract [en]

    The Convention on the rights of the child (CRC) stipulates a set of rights for all children and declares that all national legislation should be in compliance with the convention. The CRC states that the best interests of the child shall be of primary consideration in all actions concerning children; that every child has the right to protection of their family relations as well as the right to know about its parents. The purpose of this study is to investigate how well does the Swedish regulation of establishing legal parenthood comply with the child’s family oriented rights stipulated by the CRC. The study uses a critical legal dogmatic method and is analysed from a theory of the best interests of the child principle.

    The result shows that the Swedish law strongly protects the child’s right to know about his/her genetic origin. However, the findings illustrate that the mentioned right is often seen as synonymous for what is best for the child, and therefore leaves no space for questioning other aspects that may affect the child’s well-being. Furthermore the results demonstrate that the Swedish family law mainly protects hetero normative families where none of the parents has changed their legal gender. The further away from this norm that the child’s family is, the more complicated it is to establish legal parenthood and therefor harder to protect the child’s right to its family relations. The paper argues that the Swedish family law hence leaves little space for what could be seen as the best interest of a specific child in a specific context, and by doing so diverges from the CRC which advocates contextually when analysing what is best for the child. The paper concludes that a more flexible law where the best interests of the child can be taken into account in greater extent could secure the rights of the child more effectively.

    The 2022 FIFA World Cup for men's football has received massive criticism since it was announced in December 2010 that Qatar would host it. With a significant history of human rights violations, many were shocked that Qatar was elected. Non-governmental organizations (NGOs) and media reported on the ongoing abuses in the country and warned about the consequences of Qatar hosting the World Cup. Therefore, this thesis will examine these consequences and how preparations for the World Cup affect human rights in Qatar – specifically migrant workers' rights. The focus will be on Qatar, companies working with the World Cup, and Fédération Internationale de Football Association (FIFA), addressing and analyzing their responsibilities and obligations. The thesis is a descriptive analysis discussing how migrant workers' rights were violated and neglected. It is also a normative analysis that will analyze what should and could have been done to prevent it. Both Qatar's legal system and the regulation of international standards for human rights and business will be analyzed in the text. This thesis will shed light on the football world and its relation to human rights, as well as who bears the primary responsibility to ensure human rights in the preparation and execution of the World Cup. It will discuss how football and human rights affect each other, aiming to show that football organizations influence societies and social structures. Football is not only a sport but a tool that can either improve or worsen people's availability to human rights. This thesis is based on two different theories: A Marxist perspective on conflict theory and Corporate Social responsibility theory. To answer the research questions through these theories, this thesis has used a qualitative data analysis method to analyze different reports and documents from NGOs, Qatar, FIFA, and the United Nations. The thesis concludes with a summary highlighting FIFA as the prime duty bearer during the preparation and delivery of the World Cup, as well as acknowledging that Qatar, FIFA, and companies' lack of improvement and monitoring contributes to the enforcement of modern slavery/forced labor.

    Principen om självbestämmanderätt har utvecklats från att vara ett politiskt krav till en åberopbar juridisk rättighet i och med antagandet av Förenta Nationernas stadga 1945. Sedan dess har principen blivit sedvanerätt. Självbestämmanderätten har spelat en avgörande roll i att tiotals kolonier har blivit självständiga länder och suveräna stater under 1960 och 1970 talen i enlighet med FN:s avkolonialiserings resolutionen 1514 från 1960

    (Avkoloniseringsdeklarationen-1960). Principen har ytterligare förstärkts genom FN:s resolution 2625 Friendly Relations Deklarationen (FRD-1970). FRD:s innehåll anses vara sedvanerätt (ICJ-Nicaragua Case). Genom FRD har för första gången självbestämmanderätten fått företräde före statssuveräniteten när en minoritet utsätts för ett omfattande förtyck eller förvägras rätten till intern självbestämmande inom moderstatens gränser och när moderstatens regering inte representerar hela befolkningen.

     

    Koloniala makter, Storbritannien och Frankrike, ritade Mellanösterns karta 1916 genom att dra gränserna för fyra av de nya staterna genom Kurdistan vilket gjorde att Mellanösterns fjärde största folkgrupp, kurderna, hamnade som minoritet i de nybildade staterna (Turkiet, Iran, Syrien och Irak) efter första världskriget. Avkoloniserings resolutionen har inte tillämpats i kurder och Kurdistans fall trots att kurderna situation var en följd av de koloniala gränsdragningar. Resolutionen 1514 tolkades på ett sådant sätt att den kunde omfatta bara kolonialiserade territorier som inte hängde fysiskt ihop med moderstatens och territoriets folk skilde sig etniskt, språkligt och kulturellt från moderstatens befolkning. 

     

    Kurder och Kurdistans fall har varken prövats i enlighet med FRD som under vissa omständigheter ger minoriteter extern självbestämmanderätt eller enligt avkoloniserings- deklaration av Internationella domstolen, ICJ.

    Denna uppsats studerar förutsättningarna för kurdernas rätt till självbestämmande och Kurdistans självständighet med utgångspunkten i dagens folkrätt uttryckt annorlunda hur ser det ut relationen kurdernas anspråk på självbestämmande och självständighet och folkrätten.

    Wars, conflicts, natural disasters, and poverty are several reasons why millions of children worldwide are fleeing their homes and seeking refuge in other countries. The Convention on the Rights of the Child (CRC) emphasizes the obligation of the recipient countries to promote the physical and mental recovery and integration of refugee children into society. Refugee children can in turn be perceived by the host country as long-term investments or financial burdens. The objectification of perceiving human beings as assets or burdens, rather than human, is an indication of dehumanization. Dehumanizing perceptions and views are formed by people or societies and can be spread with the help of various media platforms. This study examines 24 Swedish newspaper articles, published between the years 2015-2022, with the aim to analyze whether and how the articles use dehumanizing words, expressions, and assumptions in their representation of refugee children. To identify dehumanizing words, expressions and assumptions from the selected newspaper articles, Nick Haslam's theory of dehumanization is applied. This is a qualitative content analysis, with quantitative elements. Carol Lee Bacchi’s qualitative analysis tool, what's the problem represented to be? (WPR), is used to analyze how refugee children are represented and perceived in the newspaper articles. Upon reviewing the newspaper articles, the results were decided into four overall dehumanizing categories: 1) asset, 2) burden, 3) criminality and 4) grouping. Furthermore, the results show that the dehumanizing representations of refugee children within the newspaper articles indicates mechanistic dehumanization as well as animalistic dehumanization.

    are exposed to some kind of honor-related violence that can, in the worst case, lead to another persons death. The report claims that the dark figure is much higher than what the existing figures show.

    In this essay there will be a couple of cases that will be presented. The cases has a huge part of the Swedish legal system and attitude change towards honor-related violence and honor killing. The reasoning around the cases will be presented in order for the reader to gain knowledge and concretization of the Swedish state's approach to these cases.

    This study examines Islamophobically motivated attacks against mosques. The purpose of this study has been to analyze the legal protection for Muslim groups, and explicate the underlying causes of the mosques' vulnerable situation. Violence against collective groups is criminalized in the Penal Code with the intention of counteracting racial discrimination and preventing future racial persecution. The law recognizes the protection of Muslims in order to promote the principle of the equal value and dignity of human beings. By conducting a discourse analysis of the representation of Muslims during crusades and colonization, it has been possible to understand the rise of Islamophobia. The study’s result and analysis have shown that intolerance towards Muslims is strongly linked to racism and postcolonial theory. By testing the theories and descriptively establishing the applicable law, the picture of the mosques' vulnerable situation is explained. This study provides a clear picture that attacks on mosques with Islamophobic motives are a rights issue that needs a broader discussion based on a human rights perspective.

    This study considers international norms of indigenous right to land and compares them to Swedish law and preparatory works. In a Swedish context Samí land use, typically reindeer herding, is under increased pressure from mining, forestry and other extractions of natural resources. According to this study, the international norms are clear: there are customary rights to culture, encompassing land, and rights to consultation. There are also established rights to ownership of traditional lands and natural resources. There are disputes as to the strength of these rights but they can be considered international norms to different degrees. Furthermore, there are procedural requirements such as importance of customs and eased burden of proof. 

    These international norms are considered to a low degree in Swedish law. The only traces found are rights to culture, encompassing land rights, and reindeer herding rights, an expression of land rights. These rights are not implemented in relevant legislation. Critical Race Theory explains a lot: the importance of ethnicity and racism and their connection to power emerges clearly. The state has constructed the majority view of the Samí and distributed rights accordingly. Preparatory work underlines how difficult a task it is to define land rights. The law is allowed to remain indeterminate, a disadvantage for the Samí. When rights are adjudicated by the Supreme Court the meaning is weakened. At the bottom line is a colonial view which aids commercial interests.

    Abstract [en]

    This article explores the diplomatic contestations over children’s rights in connection to the International Year of the Child (iyc) of 1979. At the time, the Year was celebrated as an outstanding success, an event which helped to heighten social and political awareness of the status of children in both developing and industrialized countries, and which brought to light a plethora of new global issues, including street children, children with disabilities and children in armed conflict. Today, the iyc is frequently reduced to a plotting point in histories charting the rise of an international discourse of children’s rights, a discourse that is intimately linked to the UN Convention on the Rights of the Child of 1989. This article shows how the concept of children’s rights was of peripheral importance to the overarching purposes of the iyc, which instead revolved around a notion of child welfare as integral to wider projects of social and economic development, either in the form of economic sovereignty or basic needs. The article then revisits the 1978–1979 UN debates on a human rights treaty for children, showing how this project initially garnered minimal support among states, international agencies and non-state actors. The article thus takes issue with teleological accounts that see the iyc primarily as a first step toward the subsequent breakthrough of children’s human rights. It also showcases how historical case studies of UN observances can be fruitful for scholars interested in the clashes and amalgamations of competing concepts and projects at an international level.

    Palestinian women detained in Israeli prisons are often subjected to systemic human rights violations. This study examines the treatment of Palestinian women in Israeli prisons, examining the extent to which these experiences align with or diverge from international human rights norms. Through rigorous analysis of existing literature, legal frameworks, and firsthand accounts, this study aims to contribute to the discourse on human rights and justice within the context of Palestinian incarceration. By examining various aspects of their treatment, including but not limited to conditions of detention, interrogation methods, access to legal representation, and healthcare provision, this research seeks to provide a nuanced understanding of the challenges faced by women within Israeli prison facilities. The findings from interviews with Palestinian female prisoners provide compelling evidence of the systematic abuses of human rights perpetrated by Israeli authorities within the prison system. In light of these findings, it is imperative to advocate for reforms within the Israeli prison system, with a focus on upholding the rights and dignity of Palestinian female detainees.

    An alien who commits a crime with imprisonment in the penalty scale can be expelled from Sweden. In order for deportation to be relevant, the alien must be sentenced to a more severe punishment than a fine. In examining the issue of deportation, the court must also take into account the alien's connection to Swedish society and make an overall assessment where the reasons for and against deportation are weighed against each other. If the alien has resided in Sweden for a longer period of time, special reasons for deportation are required, which provides a very strong protection for the alien. 

    The legislation on deportation due to crime is sparsely worded and entails ambiguities in many respects. Examples of ambiguities are which factors get into a recidivism risk assessment when there is no previously documented crime and how the factors in the assessment of an alien's connection to Sweden are to be evaluated. The problem with these ambiguities entails difficulties in predicting the outcome of the overall assessment that the court makes when the reasons for and against deportation are weighed against each other. It is reasonable to assume that the ambiguities can also lead to equal cases not being treated equally as the court is given a great deal of room for interpretation in its overall assessment. From a legal security perspective, these circumstances are problematic as legal security is largely based on the law being predictable. In order to remedy the problem, the legislator must take a clearer position and dare to legislate on the issues.

    The aim of this study was to examine whether children’s rights in deciding on compulsory care (LVU) could be fulfilled by prevailing Swedish legislation, taking into account the principle of the childs best interest. The focus of the study was to explore how the principle of the best interest of the child is considered in decisions on compulsory care. This was done by examining the child’s right to be heard during the court process and if the childs opinions and will is taken into account when deciding on LVU. I used a legal dogmatic method to analyze the U.N. convention of the rights of the child (article 3 and article 12) as well as the Swedish law sections LVU, SoL and FB. This study was based on a case study with eight compulsory care cases settled in the Swedish ”Kammarrätt”. All reviewed cases were in accordance to 2 § LVU and the age criteria for the children was between ten to fourteen years old. The result has given an insight in the different ways a child is heared during court process, some children got to express their opinions themselves and some children ́s opinions were expressed through their representative or the social welfare board ́s investigation. The children ́s opinion and their will was noted to a degree in most cases,while in some cases the children ́s opionions and will (especially siblings) was contradictory, the court had to base their judgments on what was considered to be the best interests of the child.

    In July 2021 a new penal provision on violation of a child's integrity, was introduced in the Swedish legal system. The penalty provision is found in Chapter 4 of the Penal Code. It entails a special criminal responsibility for a person who commits a criminal act against a person close to them, when the act is witnessed by a child. Children who witness domestic violence or other criminal acts between parents or persons close to them are a particular vulnerable group. These children often lack criminal law 1 protection. The new provision on violation of a child's integrity has mostly been well received. The child who witnessed the criminal act will now be a plaintiff with the right to his own special legal representative. There will be a chance that the new provision will strengthen the child's right under the Convention on the Rights of the Child. This specifically concerns Article 12 the child's right to be heard. Even so there seems to be several difficulties with the provision in the law enforcement. This essay will explore some of these difficulties.

    China's relations with African states have attracted much attention in recent years. Between the 1990s and today, China has developed into one of the most important players in the world system. During this period China has also grown to be the largest trading partner for all African states. There are diverging opinions as to whether China, in pursuit of natural resources, is taking advantage of the need for investments and infrastructure in African states, or if they are enabling possibilities of realistic and equitable development in African states. This study examines the compatibility of Sino-African trade with African guidelines for pan-African ownership, sustainable development, and human rights, by analyzing the African Union Agenda 2063 and the African Charter of Human and People’s Rights.

    I en rättsstat måste myndigheter och andra offentliga organ ge skäl för beslutsfattande som kan påverka enskilda. I Sverige grundas detta på rättsstatsprinciper som framgår i regeringsformen, och det stipuleras i förvaltningslagen. I arbetet med revideringen av förvaltningslagen skärptes motiveringsskyldigheten, vilket framgår i såväl själva lagtexten samt dess förarbeten, och förutom lagrum ska även relevanta omständigheter framgå. Trots motiveringsskyldighetens betydelse för rättsstaten så görs det inte klart vilka krav som ställs på de skäl som skall motivera besluten, exempelvis vilken typ av omständigheter som får, bör eller måste beaktas. Denna oklarhet motiverar tydliggörande forskning. Vi menar att praktiken att ge beslutsmotiveringar ska förstås som ett rättfärdigande av beslut, där såväl motiveringarnas form och innehåll är centralt. I denna artikel argumenterar vi för att reciprocitet och generalitet kan användas som kriterier för att bedöma huruvida de angivna skälen är rimliga, och att motiveringsskyldigheten bör förstås som en rätt till rättfärdigande.

    Abstract [en]

    This essay examines the implementation of the Swedish government's Action Plan on Business and Human Rights by two Swedish companies. The study is conducted using a qualitative method in combination with a comparative approach. The data analyzed consists of the UN's Guiding Principles on Business and Human Rights, the Swedish government's Action Plan on Business and Human Rights from 2015, and the Swedish legal framework on business including human rights in there sustainability report. The study also looks at the government's follow-up of the Action Plan to determine if the measures taken had any effect. The study does not take into account any new developments in the issue presented by the current government. The study finds that the two companies have implemented some of the recommendations made in the Action Plan, but not all. The analysis shows that the companies' reporting on human rights is inadequate and not in line with the Action Plan's requirements. The study concludes that more needs to be done by companies to ensure the respect for human rights and the implementation of the Action Plan.

    Abstract [en]

    This thesis will investigate The Norwegian state and state-owned businesses positive obligations to fulfill the protection of equality and non-discrimination under international and regional jurisdiction. Particularly, women rights in general and women of ethnic minority’s rights. A positive critical legal method, based on a feminist theory, will be used to analyze the United Nation, European and Norwegian regulations. To illustrate the laws in practice the thesis will look at court decisions from both European Court Justice (ECJ), Norwegian Gender Equality Tribunal and The Norwegian Supreme Court. Even though the regulations exist, there is still a problem with respecting women’s rights in Norwegian society in general and in labour market. What is interesting to investigate is therefore the reason behind the disrespect, and to look for sustainable opportunities to include women’s experiences in the traditional jurisdiction. The conclusion is that there is space for implementation of women’s rights in human rights, and a transformation of the existing traditional legal system to “engender” the “mainstream” legal system is in place.

    The purpose of the study is to investigate the governance by the Swedish government of the state-owned enterprises in relation to UN Guiding Principles for Business and Human Rights. In the study the Swedish state’s ownership policy is analyzed together with the Swedish national action plan for business and human rights in relation to article 4 in the UN Guiding Principles.The method used in the study is a critical legal reasoning around the text combined with other external perspectives such as the underpinning values and the context. The conclusion of the study is that the Swedish state’s ownership policy should be interpreted in the light of international law, since there are compelling reasons grounded in previous research that article 4 in the UN Guiding Principles is related to the state’s duty to protect and the requirement of due diligence. The study demonstrates that the Swedish government has taken several steps in relation to the state-owned companies, although it is hard to conclude that these are additional in the meaning of article 4. The requirement in the UN Guiding Principles on state-owned enterprises to perform human rights due diligence and supported by international law is not expressed in the State’s ownership policy. Another conclusion is that the requirements and expectations on state-owned enterprises with regard to human rights are integrated with firm expectations on business opportunities. These requirements and expectations could be characterized as instrumental for the overriding objective of the state-owned enterprises: long-term value generation.

    The present study focuses on the issue of unaccompanied minors (UAMs) and trafficking and is a case study about Greece. Its purpose is to comprehend the factors that make UAMs vulnerable to trafficking, highlight gaps in protection measures, and evaluate the effectiveness of the legal and policy framework. It is important to research this subject because of its utmost importance as a critical human rights issue. By delving into it, human rights values are upheld and contribute to the broader goal of safeguarding children and preventing trafficking globally. Vulnerability theory and securitization theory form the basis of this thesis and a qualitative method was used with field research conducted through semi-structured interviews. The results showed that UAMs represent a vulnerable group at risk of trafficking in Greece or possibly be already victims from their country of origin or during the migration journey, attributable to existing gaps in their protection and various contributing factors. The results of this study include the need for establishing a national child protection system, improving protection measures and preventive mechanisms, and fostering collaboration with stakeholders to protect these children.

    The European Union (EU) is based on the inclusive core values ​​of democracy, the rule of law and respect for human rights enshrined in article 2 of the Treaty of the European Union. If there is a risk that these values ​​are systematically threatened within a member state or when breaches are a fact, the EU may act by applying legal and political mechanisms. The purpose of this paper is to highlight the problem with EU member states abandoning the democratic principles in favor of the illiberal, as exemplified by a case study on Hungary whose constitution and national identity are based on exclusionary values, which consequently has implications for human rights. The main focus of the thesis is the article 7 procedure which has a sanctioning mechanism that may result in the member state concerned being wholly or partly deprived of its voting rights in the Council of the European Union. Article 7 has been criticized for being ineffective and too political. In September 2018, the European Parliament adopted a resolution which activated the preventive mechanism of the procedure against Hungary which is about deciding whether there is a risk of breaches of article 2. The main ambition of the study is to discuss to what extent article 7 can protect the EU's core values. For these purposes, a jurisprudence method that examines EU law has been applied and, through a political science approach, the application of article 7 against Hungary has been investigated. In order to gain a deeper understanding of the procedure, a field study trip was made to the European Parliament in Brussels, where interviews were conducted with people with insight into the work of Parliament and the Council. I was also given the opportunity to attend a meeting of the Committee of Civil Liberties, Justice and Home Affairs of the European Parliament, in which representatives of the European Commission and the European Union Council also participated. The theme for the discussion was the article 7 procedure against Hungary. The findings of the survey show that, due to the political nature, article 7 is not sufficiently capable of protecting the fundamental values ​​of the EU. What is needed is a new independent mechanism to review all member states' compliance with democracy, the rule of law and human rights.

    The aim of this thesis is to inspect how international law tends to exclude girls’ as holder of their rights, when they are associated with armed conflict. From the view of a legal approach, different terms in conventions- optional- and additional protocols have interprets and systematizes to make de lege lata for girls’ in international law able to establish. From the theoretical sight of formal and substantial equality, which assume that equal rights do not function in a world build on the structure of a male, the research of the study shows a number of terms within international law that tends to exclude girls as holders of their rights. The result shows that those terms due to social construction, which express the differences between girls and boys, is overlooked in the international lege lata. The result makes therefore the male standard of the terms advantage for boys.
