The human right to mental healthcare: Bridging the rights-gap for women subjected to sexual violence2019Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [en]

Sexual violence against women is not only a serious public health problem of epidemic proportions, it’s also a violation of women’s human rights. The devastating consequences of these events on women’s health have been widely documented. The overarching purpose of this thesis is therefore to explore why public healthcare facilities around the world often fail to provide victims of sexual violence with mental healthcare of good quality that is available, accessible and acceptable. In order to investigate this, the legal grounds of specialized healthcare for victims of sexual violence was documented. Secondly, an exploration of whether the Swedish healthcare system provides victims of sexual violence with access to the highest attainable standard of mental healthcare was carried out. Lastly, the history of violence against women was explored in order to identify reasons for why the right to mental healthcare often fail to work in practice for female victims of sexual violence despite apparent agreements. Also, constructive suggestions are put forth regarding what governments can do to provide victims of sexual violence with access to the highest attainable standard of mental healthcare. An interdisciplinary approach of political sociology was used to illustrate the multiple dimensions of human rights. The findings suggest that the right to mental health is an integrated part of the right to health and thus a fundamental right for all human beings. However, the results indicate that the right to mental healthcare for women who have been subjected to sexual violence is not available, accessible and of good quality within the Swedish healthcare system. The study concludes that one of the main barriers to make the right to mental healthcare accessible for this group of patients is the lack of an officially recognized name that include the many different syndromes these women suffer. Findings are discussed in relation to previous research.

The best place to be young and a female: a study about gender equality in Rwanda2019Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [sv]

    Abstract [sv]

    Abstract [sv]

    Abstract [en]

The aim of this thesis has been to identify the causes and consequences of unaccompanied children disappearing. The method used in the study is a qualitative text analysis where approaches aim to investigate a problem that exists in society, but where it is important to describe and understand the reality that the unaccompanied children who disappear in Sweden go through.

The results analyzed are based on the three most common causes and consequences of unaccompanied children disappearing. The causes show that there is a huge concern among the children before they turn 18 years old, a lack of participation of the child in the placement of it and mental ill-health and trauma. The children have a great sense of fear, which is based on the feeling of hopelessness and of getting a negative response on their asylumapplication. Furthermore, the results demonstrate that the consequences that children face when they turn to living on the streets are that they are exposed to human trafficking, sexual exploitation, other forms of crime and drugs. When children deviate and disappear, it becomes difficult to fulfil many of their rights under the Convention on the Rights of the Child. By analyzing the causes and consequences from a child's perspective, one better understands the reasons why children differ and how important it is to handle situations according to achild'sperspective by listening to children.

This study also highlights and clarifies problems that children meet in the asylumprocess, in which authorities often fail in the safe reception and care of the unaccompanied asylum seeking children that deviate and disappear.

Civil olydnad i Sverige: - Går det att rättfärdiga?2020Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [sv]

John Rawls defines civil disobediance as a ”public, nonviolent, conscientious yet political act contrary to law usually done with the aim of bringing about a change in the law or policies of the government.” (Rawls, 1999:320). Rawls has developed a theory of civil disobediance that has been widely discussed (Månsson, 2004:153). His theory explains when one can break the law and what has to be taken into consideration (Rawls, 1996:345-346). The theory is designed only for the special case of a nearly just society where the members of the community are rational beings. Rawls has a democratic and constitutional perspective that cares for a stable state power. The theory has been criticized by philosophers such as Kimberley Browlee and Tomas Månsson that claim that it is too narrow (Månsson, 2004:157-159, Brownlee 2012:2). The Swedish legal system does not regulate civil disobediance in any particulary law, rather it is the criminal acts that are connected to the civil disobediance that are prohibited. A dilemma for the criminal law is the amount of tolerance that should be allowed for criminal acts that we morally can understand (Asp & Ulväng, 2019:13). In common practice there has been a very low acceptence of civil disobediance. There has not been any case of discharge and the court has expressed a concern in judging these acts too light (NJA 1982 s. 376).

Suveränitet, veto och erga omnes- käppar i hjulet?: Ett studie av konflikten i Syrien utifrånde lega lata, de lega ferenda, de lega interpretata.2018Independent thesis Advanced level (degree of Master (One Year)), 10 poäng / 15 hpOppgave
    Abstract [en]

Seven long years of conflict in Syria with humanitarian catastrophe as consequence. The UN and the blocked Security Council, with the inability to address the deteriorating political andhumanitarian situation in Syria, actualizes the former Secretary-General Kofi Annan's words beforethe General Assembly in 2000:"... if humanitarian intervention is, indeed, an unacceptable assault on sovereignty, how should werespond to a Rwanda, to a Srebrenica - to gross and systematic violations of human rights thataffect every prescription of our common humanity?"From the Cold War until today, the UN system has failed to live up to the high expectations basedon the fundamental principles of the Charter and international law, which can be attributed to theimbalance between the General Assembly and the Security Council, as well as within the Councilbetween the five permanent members with individual veto and the chosen six.The question is not new. The tension in power balance and decision-making in the UN has existedsince the organization's formation. Interestingly in this context, the resolution Uniting for Peace, which was adopted in 1950, has as its starting point the unrestricted power of veto in relation to theGeneral Assembly's responsibility for peace and security. The resolutions Responsibility to Protect and Uniting for Peace become important and necessaryfor the understanding of the conflict in Syria, but also for a reform work motivated by humanitarianlaw. The meaning of the concepts of sovereignty, veto and erga omnes is therefore decisive in thebalance between de lege lata and de lege ferenda, with can be clarified by de lege interpretata. This essay will try to make the connection between these concepts more intelligible.

Mötet mellan Agenda 2030 och mänskliga rättigheter på lokal nivå: En intervjustudie med politiska partier, förvaltning och civila samhället inför implementeringen av Agenda 2030 i Stockholms stad2020Independent thesis Advanced level (degree of Master (One Year)), 10 poäng / 15 hpOppgave
    Abstract [en]

The City of Stockholm has declared that it will be leading in the implementation of Agenda 2030. The study is based on interviews with political parties, representatives from the administration and civil society actors in the City of Stockholm. It explores how concepts within and the relation between Agenda 2030 and human rights are perceived. The results of the study are based on four themes: to leave no one behind, politics, language and practice, and partnership. A tension between human rights and Agenda 2030 is found, but also commonalities. The study shows that in local administration, Agenda 2030 and the Sustainable Development Goals are often regarded as more practical than human rights. Yet, respondents believe that human rights can strengthen Agenda 2030. Across all respondent groups, the study finds that there are expectations of Agenda 2030 breaking silos, uniting actors and offering a framework that is stable over policy shifts

    Abstract [en]

The issue of Christian Zionism is one that is fiercely debated within theology, the church, politics, and society. Comprehending Christian Zionism brings together an international consortium of scholars and researchers to reflect on the network of issues and topics surrounding this critical subject. The volume provides a lens on the history of Zionism within Christian theology and offers a constructive, multidimensional path for assessment and introspection around the meaning of Zionism to Christian faith and practice.

    Abstract [en]

This thesis investigates how three high schools based in Stockholm organize their sex education. Do the schools meet the guidelines and policies for sex education or in which way do they not? The study is based on interviews with school staff and is analyzed through a new institutional theoretical perspective. According to the Swedish National Agency for Education, sex education overbridge various subjects; concepts like sexuality, equality, sex and relations are expressed in several high school curriculums. The Swedish National Agency for Education further explain that all teachers are affected by these questions, since it is related to the schools basic principles and values. The main result shows that the quality of sex education is dependent on the commitment from teachers, headmasters and students. Together they create certain norms, values and atmospheres which makes sex education to a very big challenge and sometimes a success.

    Abstract [en]

1994 in Cairo United Nations Population and Development Fund held a conference where the attending 179 nations agreed that Sexual and reproductive health is a human right. Everyone is entitled to this right without distinction.

This thesis investigates what covenants, declarations, policies, strategies and national law say about sexual and reproductive rights for men, specifically men in Sweden.

The thesis aims to enlighten the reader about men’s situation in a welfare state where discriminatory structures in society is reproducing gender stereotypes in a country that is one of the most gender equal countries in the world.

The general lack of common knowledge and subsequent lacking education in the matter is abundantly clear when browsing documents issued by official sources throughout the world. While Europe and its countries have begun to examine and call attention to this neglected subject, progress is still slow and could be hazardous to men’s sexual and reproductive health.

The thesis concludes with an argument that Sweden have a discriminatory structure built in society that discriminate men and their right to sexual and reproductive health according to Discrimination Act 2008:567 by practices that appear to be neutral but can affect men in a negative way.

Barnets rätt till sina föräldrar: En kritisk rättsdogmatisk analys av rättsligt föräldraskap i relation till Barnkonventionen2019Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [en]

The Convention on the rights of the child (CRC) stipulates a set of rights for all children and

declares that all national legislation should be in compliance with the convention. The CRC

states that the best interests of the child shall be of primary consideration in all actions

concerning children; that every child has the right to protection of their family relations as well

as the right to know about its parents. The purpose of this study is to investigate how well does

the Swedish regulation of establishing legal parenthood comply with the child’s family oriented

rights stipulated by the CRC. The study uses a critical legal dogmatic method and is analysed

from a theory of the best interests of the child principle.

The result shows that the Swedish law strongly protects the child’s right to know about

his/her genetic origin. However, the findings illustrate that the mentioned right is often seen as

synonymous for what is best for the child, and therefore leaves no space for questioning other

aspects that may affect the child’s well-being. Furthermore the results demonstrate that the

Swedish family law mainly protects hetero normative families where none of the parents has

changed their legal gender. The further away from this norm that the child’s family is, the more

complicated it is to establish legal parenthood and therefor harder to protect the child’s right to

its family relations. The paper argues that the Swedish family law hence leaves little space for

what could be seen as the best interest of a specific child in a specific context, and by doing so

diverges from the CRC which advocates contextually when analysing what is best for the child.

The paper concludes that a more flexible law where the best interests of the child can be taken

into account in greater extent could secure the rights of the child more effectively.

The Significance of Culture in Human Rights: Three dimensions of cultural relativism in the universal human rights discourse.2018Inngår i: Proceedings of the Annual ACM Symposium on Theory of Computing, ISSN 2251-2403, E-ISSN 2078-0435, s. 94-102Artikkel i tidsskrift (Fagfellevurdert)
    Abstract [en]

The question of culture in the international human rights discourse has since the adoption of the Universal Declaration of Human Rights in 1948 been relatively marginal, but have recently taken new turns. This article argue that there are several dimensions of cultural relativism in human rights despite its universalistic pretentions. The reason for the cultural relativistic turn in human rights is that nations, cultural groups and legal structures explicitly question the ability' of the universal discourse to address the concerns of nations, individuals, and cultural groups. Finally, it is suggested that these human rights dilemmas may be solved by national and local transformation and application of the universal discourse.

The Race to the Bottom: -A Minor Field Study of H&M’s CSR in practice2019Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [en]

CSR has become a tool for global corporations to justify their outsourcing practices in other countries. Despite these CSR policies, reports reveal that labor rights violations are common in these supply chains, and not at least in the garment industry. The purpose of this study is therefore to explore how a global clothing company’s CSR policy on labor rights is working on the ground and which factors that influence its implementation. Interviews with factory workers and experts on the topic have taken place in one of India’s largest garment hubs. The findings are based on thematical analysis and the analysis suggests that the global brand (H&M) could improve the situation by taking certain actions though several external factors also have an affect. The responsibility for poor labor conditions needs to be divided between multiple actors who all have a duty to act within their spheres of influence. The study concludes that the underlying problem of economic exploitation must be brought to an end through increased cooperation between global companies.

On July 1st 2018, a new law entered Sweden that would hopefully will lead to a better justice process regarding sexual offenses. This law was given the name consent

law, which states that sex should be voluntary for the parties who are involved in the sexual acts. If not, the offender will be charged with rape.

The majority of convictions for rape have easily led to the perpetrator being released from the charges. This indicates that something is not right and it’s not wrong with the evidence, the parties or persons working with the cases, but it is something that is defective in the law that has been found before. The previous laws, the Swedish Committee has considered that some terms are outdated for use in the current law.

The previous laws did not agree with ECHR articles and since Sweden has ratified it, the national laws needed to be comprehensive.

Through the course of the essay, we will go through various factors that have led to the current legislation, what resistance it has received and what criticism has it received when it came into force? It will be described what the law looks like and what application difficulties it may have.

The purpose of the new law is to strengthen the sexual integrity of the victim and criminalize the perpetrator's behavior and negligence, which will be included in the thesis. Negligence is a new crime that came in connection with the new law. The law is designed to change the image of the ideal victim and put more focus on the perpetrator's actions to change the society's image of what rape is and hopefully more people will gain more knowledge, which will make big changes in the long run.

    Abstract [en]

The aim of this thesis is to investigate the discrepancies between theory and practice when it comes to humanitarian interventions in refugee camps. In order to contextualize the result it will be applied onto the work with sexual and reproductive health and rights (SRHR) and young women in the world’s biggest refugee camp in Cox’s Bazar, Bangladesh. The research questions are as follow: What discrepancy does relief worker experience when it comes to theory and practice in humanitarian interventions in refugee camps?; what kind of difficulties and challenges do relief workers meet in their work in refugee camps and how do they prepare?; what is the best way to work with SRHR questions and young women in the refugee camp in Cox’s Bazar in Bangladesh?

The study is built on interviews with five relief workers from western relief organizations. In order to be able to answer the three research questions, the interviews focused on the following themes; discrepancies of theory and practice; use of theoretical guidelines like The Sphere Handbook; difficulties during humanitarian interventions in refugee camps; and lessons learned. Some of the respondents had experience from Cox’s Bazar and/or SRHR and were therefor asked questions due to that specific experience.

Conclusions to be drawn from the results of the interviews are that it is possible to prepare one self to work in humanitarian conditions but only to a certain extent. Relief workers do need a great deal of experience but there will always be unexpected situations impossible to prepare for. It’s also clear that some basic methods, such as actually talking to the people in need and not only acting on previous experiences, still need to be highlighted. In the specific context of Cox’s Bazar and SRHR questions, relief workers need to understand the culture in order to pursue their work in a suitable way. SRHR questions are for example highly stigmatized and the women’s previous knowledge about their own body is in general very low.

    Abstract [sv]

Klimatapartheid: En retorisk analys2020Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [en]

How we talk about climate is almost as important as how we deal with it. How we choose our words, what tactics we use to persuade each other and how we get our points across, it will all influence the choices we make to adapt, mitigate and set rules for dealing with climate change. In the summer of 2019 special rapporteur Philip Alston released his report on climate change and poverty. The report came at around the same time as the newsfeed was filled with images of California’s wildfires burning down neighbourhood after neighbourhood. But the discussion soon turned to debates regarding the use of private firemen to protect the houses of the rich and famous, in other words: the privatization of basic services. In his report Alston warns us about a scenario where the rich can pay their way to safety and the poor must face the consequences of climate change, he named the scenario climate apartheid. The purpose of this essay is to understand what Philip Alston means when he warns of an impending climate apartheid scenario and understand what consequences he sees. The method used to make the study is a critical rhetoric analysis, I have studied the rhetorical strategies Alston have used to try to persuade his readers. I have also used the theory of Yueng Foong Khong of analogies of war to try to understand the analogy of climate apartheid. What is said about climate apartheid is that it threatens the lives and rights of millions of people and it is of most importance that a strong and swift global cooperation is needed to save ourselves and protect the most vulnerable.

    Abstract [en]

This study intends to concretize the concept of ”human dignity”, as well as see to its role inpolitics, and what consequences it has on juridical implementation. The discussion deals withthe importance of citizenship in Sweden. The purpose of the study is to focus onundocumented immigrants, their conditions and what implications a lack of citizenship has onthe group in question – ergo which connection actually exists between human dignity andcitizenship. Using the research questions it is discussed whether the concept of ”humandignity” is able to concretize, as well as if it possible to determine an ethical duty towardsundocumented immigrants based on the principle of human dignity. The essay is based on a social constructivist theory which, alongside a criticaldiscourse analysis in accordance with Faircloughs three-dimensional model, aims to theorise awell-discussed and established concept as well as power relations in society, and how acondition as an undocumented immigrant creates a new form of powerlessness. The methodproblematises the importance of citizenship for the experience of having human dignity. With this as the basis of the essay the result mainly shows the meaning of theconcept of ”human dignity” from ethical, political and legal perspectives, as well as therelation between the concept and citizenship. Thereafter the essay examines citizenship, partially from a general perspective but with its main focus on Sweden. Undocumentedimmigration serves as a counterpart to citizenship, which is concretised through an evaluationof the conditions of undocumented immigrants in Sweden at present. The analysis thatfollows aims to show that human rights are not the only fundamental thing for experiencingan intrinsic value, hence the discussion must go further, by showing that human dignity canserve as an adequate starting point to ensure a fundamental protection of individuals. This dueto the fact that the meaning of the concept goes further than claiming rights, and therebyshedding light to an additional nuance of the meaning of being human.3The conclusions that follow shows the problematics that the essay raises, butmoreover the possible areas for change or improvement that comes with the increasedresonance of the concept, as well as its established importance.

Etnisk diskriminering och afrofobi på den svenska arbetsmarknaden.: En empirisk studie om erfarenheter av rasism och diskriminering.2018Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [sv]

    Abstract [sv]

    Abstract [en]

Vulnerability is a part of human existence, a substantial dimension of what it means to be human. As several scholars have convincingly argued, the concept of vulnerability challenges any attempt to reduce the question of human dignity to a protection of individual autonomy.

We contribute to the discussion by arguing in favor of a more dialectical understanding of the relation between vulnerability and human rights. We start off with a short presentation of our view of the Swedish case of medical age assessments. In the next step we formulate what appears to be a paradox—the Swedish state incorporating the United Nations Convention on the Rights of the Child (CRC) and, simultaneously, enforcing inhumane restrictions on the rights of young asylum seekers. We proceed by deconstructing the paradox and arguing that these seemingly conflicting trends can be explained as manifestations of two different but interrelated dimensions of the current human rights culture, namely, juridification of human rights protection and reduction of vulnerability to a function of age. In the concluding part of the chapter we offer a critical reflection on the relation between authentic human rights protection and human vulnerability.

Hederskultur2019Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [sv]

Sex trafficking in India: A study in how to combat sex trafficking2019Independent thesis Advanced level (degree of Master (One Year)), 10 poäng / 15 hpOppgave
    Abstract [en]

This paper will strive to obtain an understanding for sex trafficking in India, underlying reasons for it and solutions to it. The study includes a case study of STOP, an organization working against sex trafficking in India. The main objective being to study what, according to an organization working with the issue, is the best course of action when working towards combating sex trafficking in India; what factors STOP believe contributes towards sex trafficking, how to help the victims of sex trafficking, challenges they experience in their work and what they believe are the solution to ending sex trafficking in India. STOP has been active in India since 1990, working towards combating sex trafficking och rehabilitating survivors. The reason for focusing on sex trafficking as a human rights issue can easily be shown in the staggering numbers surrounding it:According to the 2017 report conducted by the International Labor Organization (ILO) there was an estimated 24.9 million people trapped in modern slavery. 4.8 were victims of trafficking. Women and girls make up 71 percent of the victims, the number of children below the age of 18 is estimated to be 5.5 million. The largest number of trafficking can be found in the Asia-pacific region with 62% of the cases or 15.4 million victims. The profit made from human trafficking globally is estimated to be around 150 billion dollars a year for the trafficker, this according to an ILO report from 2014. Sex trafficking stands for 99 billion dollars. In stark contrast to the staggering numbers of victims and profits made from sex trafficking, are the cases of prosecutions and convictions. In the year 2016, 14,894 prosecutions took place globally with 9,071 convictions. In South and Central Asia there were 14,706 victims identified, 6,297 prosecutions and 2,193 convictions (Human rights first, 2017).The numbers are staggering and the act of sex trafficking is one of the greatest crimes against human rights today. The modern term for slavery, it is a crime that strikes against the most basic of human rights. Still it is a multi-million industry that is spread around the world, with India being a particularly affected country. What is done to stop it and what is the best way of working towards stopping it? That is something that will be discussed in this thesis.

Rätten till asyl: Den EU-rättsliga aspekten på området i samhörighet med dess internationella påverkan2018Independent thesis Advanced level (degree of Master (One Year)), 10 poäng / 15 hpOppgave
    Abstract [en]

This essay aim to concern the regulations regarding asylum, foremost in the European Union and partly in an international context. After having a course about human rights in a European perspective I decided that I wanted to know more about the right to asylum, and therefore the regulations regarding asylum in a European judicial context as well as in an international approach. The three main question formulations are: 1. How are the overall EU legal frameworks as regards asylum law constructed? 2. What does the international principle of Non-Refoulement (not sending back refugees who risks being subject to inhuman punishment) implicate, which is sometimes referred to within asylum law at a EU level? 3. What is the situation as things stand in the field of asylum and migration? The purpose is to carry out an investigation of the right to asylum, as it is applicable in the judicial field. Furthermore, the aim is to carry out a comprehensive investigation of right regarding asylum order to further limiting the investigation somewhat with relevant regulations as well as legal principles in the area. Forward the purpose is to, partially study how the major regulations in the area of asylum law are able to be subject for comparison, but also to see how they can correlate. The aim is therefore to highlight these general, but crucial regulations that exists within the field of asylum mainly at a EU level and a little lesser internationally, in order to carry out an analytical comparison between them. The method for the essay entails an interpretation of the regulations by means of grounds of legal dogma and thereinafter with a comparative method. The result of the essay reveals that the European regulations regarding asylum is immensely inclusive containing a broad spectrum with everything from the right to asylum, criterias and mechanisms for administration of asylum applications, the best interest of the child to the rights which are destined to accrue to those who seeks asylum. The result also demonstrates that the international regulations as well as the European regulations provides for the rights which are destined to accrue to those who seeks asylum. The result also demonstrates that the international principle of Non Refoulement fully aim to protect those in need of protection of their lives or freedom to return to areas where this can be adventured. Likewise the result demonstrates that the regulations in these area both can be compared as well as they can be placed in relation to each other because of their correlation. The analysis of the essay, as well as its conclusion directs that the regulations are able to be put in a tighter context than it at first seems like. Additionally the essay detects that the European regulations, particularly those in stages of revise would be very helped by more influence from the international regulations, for example The Convention Relating to the Status of Refugees.

HALT RACIFICATION: A qualitative study on anti-racists halt of racification apropos the Swedish Discrimination law(2008:567).2018Independent thesis Basic level (Higher Education Diploma (Fine Arts)), 10 poäng / 15 hpOppgave
    Abstract [en]

This thesis studies the arguments for and against the removal of the word race from the Swedish Discrimination Law. Questions on race creeds in the society, rationalities and use of the word Race and its meaning linger in all spheres and are inescapable. One of the reasons could be the brutality carried in the word race and yet it remains to be part of the international vocabulary. Human beings are protected from Racial violations by International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and in it there is use of the word Race. Normative theory is used to analyse the Arguments from debates by antiracists and other materials to find the rationality in or without the word race in law. Do anti-racists halt racification, with or without using the word race in the Swedish law? This is the research question. The results indicate that the anti-racists do not halt racification, with or without using the word race in the Swedish law. This thesis is a call to illegalise racification and have clear description in the law on matters of racism. This thesis purposes to add onto the bank of an anti-racist arguments. It advocates for a halt of racification on human beings as a necessity for resolving racism.

    Abstract [en]

The aim of this thesis has emphasised on justice within the regulation constructed by The International Association of Athletics Federations (IAAF) concerning the eligibility for the female classification (athletes with Difference of Sex Development). Different arguments in IAAF:s regulation has been examined throughout a philosophical analysis to examine the validity of the regulation. The IAAF:s regulation validity is examined through the capabilities approach, which aims to promote individual justice of an individual and what the individual can become to her fullest. The other theory of justice originates from utilitarianism which is a type of justice that aims to bring the most fortune to the greatest amount of people. IAAF:s regulation is a governing tool which controls participation of female athletes in the elite level sport in races at international competitions. The women who get affected by its implementation are women who suffer from DSD (Disorder of Sex Development). The regulation requests that women with DSD, who develop higher amount of testosterone than the average woman, must undergo medication to participate in international competitions in different races. The effect of the medication results in the deterioration of their natural physiological health. IAAF considers it necessary since some women with DSD has an advantage in comparison to the average female athletes in the same race events. Throughout the capabilities approach this may seem as an unjust type of regulation for women with DSD. The theory of utilitarianism may see it as justice for the majority of female athletes. When applying these two types of justice, the capabilities approach and utilitarianism, the result will differ. The sports organisation IAAF has also been compared to other sports organisations. The comparison lies within what sport aims to be for the athlete. Before beginning with the analysis, the history of different control mechanism of the female athletes’ bodies will be presented to show the reader the complexity that lies in the female category of elite sports level.

Internationell adoption: En studie kring Sverige, adoption och argumentet ”internationell adoption för barnets bästa".2020Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [en]

The purpose of this study is to examine factors to why international adoption is seen positive

in the Swedish society, which contributes to why international adoption is argued as something

good from a child perspective. The study aims to highlight arguments that contradicts the

picture of adoption as only positive through criticizing and problematizing international

adoption as practice. The study came to the conclusion that the Swedish politics, Sweden as a

democratic role model and international adoption as a charity are three aspects to why it can be

argued as something positive. Also, that adoption can be more harmful than what is showed in

the society. That people’s need to adopt from the Third World can be argued to why

international adoption can be human trafficking. Through a postcolonial perspective

international adoption can also be seen as an asymmetric power structure between West and the

Third World. Through that, the politics in Sweden must flag this part of international adoption

to widen the perspective and by that, present how real changes can be made to why people in

the Third World are forced to leave their children for adoption to the West.

The purpose of this paper was to examine and analyze Jomshof's argument in "Interpellationdebate 2017/18: 434 prayer call", where he proposed that freedom of religion be restricted byadopting a Swedish ban on Islamic prayer calls. In this work, a normative qualitative textanalysis has been used to investigate why Jomshof gives this proposal and how he does it. Ihave investigated this by examining the debate itself, but also by placing Jomshof's views intoa broader context of society and party ideology. Results from my analysis show that the centralviews the debater bases his proposal on is that the legal situation allows the realization of theproposal, that Swedish democracy is threatened, and that Swedish secularization must bepreserved. My analysis results also show that Jomshof's discourse is xenophobic and has racistundertones and that Jomshof wants to create an image of the existence of hierarchies amongpeople. What my analysys also showed was that negative consequences on individual andcommunity levels could occur if Jomshof's proposal was made law. Even if his opinionsexpress, and the way how he expresses them, could have negative consequences.

"Korruption i Demokratiska Republiken Kongo": En kvalitativ studie om konsekvenserna av Korruption i Kongo2018Independent thesis Basic level (degree of Bachelor), 10 poäng / 15 hpOppgave
    Abstract [en]

The main purpose of this study is to investigate how the corruption in the capital city (Kinshasa) of Democratic Republic of Congo (hereafter Congo) affects the inhabitants of the country, how common corruption is in Congo and how the people living in the country suffer from corruption. The secondary purpose of the paper was to investigate the consequences of corruption for those living in the country. The argumentation is analyzed by a semi-qualitative method using a questionnaire with quantitative and qualitative (open) questions answered by residents in the capital city of Congo. Kinshasa is a city characterized by great contrasts. In the city of Kinshasa there are areas with luxury residential neighborhoods, business areas and several universities, but also large and rapidly growing areas where poor people live. Residents from these two different areas of Kinshasa have been asked. The primary data analysis showed that the participants living in the poorer areas, to a greater extent than those living in the prosperous areas, find it common for corruption in Kinshasa to occur. They also argue that society is overcoming the problems of corruption in Kinshasa and that they suffer from corruption in Kinshasa to a greater extent than those living in the prosperous areas. Har EU det som krävs för att skydda de mänskliga rättigheterna?: En studie om artikel 7 i Fördraget om den Europeiska Unionen.2019Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [en]

The European Union (EU) is based on the inclusive core values of democracy, the rule of law and respect for human rights enshrined in article 2 of the Treaty of the European Union. If there is a risk that these values are systematically threatened within a member state or when breaches are a fact, the EU may act by applying legal and political mechanisms. The purpose of this paper is to highlight the problem with EU member states abandoning the democratic principles in favor of the illiberal, as exemplified by a case study on Hungary whose constitution and national identity are based on exclusionary values, which consequently has implications for human rights. The main focus of the thesis is the article 7 procedure which has a sanctioning mechanism that may result in the member state concerned being wholly or partly deprived of its voting rights in the Council of the European Union. Article 7 has been criticized for being ineffective and too political. In September 2018, the European Parliament adopted a resolution which activated the preventive mechanism of the procedure against Hungary which is about deciding whether there is a risk of breaches of article 2. The main ambition of the study is to discuss to what extent article 7 can protect the EU's core values. For these purposes, a jurisprudence method that examines EU law has been applied and, through a political science approach, the application of article 7 against Hungary has been investigated. In order to gain a deeper understanding of the procedure, a field study trip was made to the European Parliament in Brussels, where interviews were conducted with people with insight into the work of Parliament and the Council. I was also given the opportunity to attend a meeting of the Committee of Civil Liberties, Justice and Home Affairs of the European Parliament, in which representatives of the European Commission and the European Union Council also participated. The theme for the discussion was the article 7 procedure against Hungary. The findings of the survey show that, due to the political nature, article 7 is not sufficiently capable of protecting the fundamental values of the EU. What is needed is a new independent mechanism to review all member states' compliance with democracy, the rule of law and human rights.
