    Titel: När samhället sviker barn. 

    - Om hur barn i Sverige hamnar i utsatthet stolt företagande sociala insatser.   

     Jag har uppsatser har författare på att stänga av en kvalitativ forskningsmetod för att undersöka hur socialtjänstens arbete rörande frågor kring låtar trygghet brister, och där barnen långt illa. Det här är en aktiv aktiv insatser som ska motarbeta och utlåter utsatthet och där engagemang kring frågor som rör barn varit prioriterad sedan länge. Uppsatsen har inspirerats av diskursanalys som metod och teori. Den innehåller även det teoretiska begreppet ¨ barnets bästa¨ och BBIC som ett analytiskt verktyg. Resultatet visar att Socialnämnden argumenterar utifrån föräldrars brister och det misslyckade föräldraskapet i förhållande till barns behov. Vidare framkommer att argumentationen förs utifrån lagstiftningen förutsättning syftar till att uppnå mer effektivitet i administration än att beakta barnets bästa.

    Abstract [en]

    The Convention on the rights of the child (CRC) stipulates a set of rights for all children and

    declares that all national legislation should be in compliance with the convention. The CRC

    states that the best interests of the child shall be of primary consideration in all actions

    concerning children; that every child has the right to protection of their family relations as well

    as the right to know about its parents. The purpose of this study is to investigate how well does

    the Swedish regulation of establishing legal parenthood comply with the child’s family oriented

    rights stipulated by the CRC. The study uses a critical legal dogmatic method and is analysed

    from a theory of the best interests of the child principle.

    The result shows that the Swedish law strongly protects the child’s right to know about

    his/her genetic origin. However, the findings illustrate that the mentioned right is often seen as

    synonymous for what is best for the child, and therefore leaves no space for questioning other

    aspects that may affect the child’s well-being. Furthermore the results demonstrate that the

    Swedish family law mainly protects hetero normative families where none of the parents has

    changed their legal gender. The further away from this norm that the child’s family is, the more

    complicated it is to establish legal parenthood and therefor harder to protect the child’s right to

    its family relations. The paper argues that the Swedish family law hence leaves little space for

    what could be seen as the best interest of a specific child in a specific context, and by doing so

    diverges from the CRC which advocates contextually when analysing what is best for the child.

    The paper concludes that a more flexible law where the best interests of the child can be taken

    into account in greater extent could secure the rights of the child more effectively.

    Abstract [en]

    The question of culture in the international human rights discourse has since the adoption of the Universal Declaration of Human Rights in 1948 been relatively marginal, but have recently taken new turns. This article argue that there are several dimensions of cultural relativism in human rights despite its universalistic pretentions. The reason for the cultural relativistic turn in human rights is that nations, cultural groups and legal structures explicitly question the ability' of the universal discourse to address the concerns of nations, individuals, and cultural groups. Finally, it is suggested that these human rights dilemmas may be solved by national and local transformation and application of the universal discourse.

    Uppsatsen syfte är att undersöka de hebreiska begreppen neshama och ruach och att jämför dessa med varandra.

    Neshama är ett sällsynt begrepp som bara används 24 gånger i den hebreiska bibeln. Ruach däremot är ett vanligt begrepp som används 378 gånger. Begreppen är delvis synonyma när de betecknar andedräkt, både Guds och människans andedräkt, och när de betecknar livskraft. Utöver detta har båda begreppen betydelser som inte täcks av det respektive andra begreppet: Neshama används t.ex. som kollektivbeteckning för varelser, det som andas, en betydelse som ruach inte har. Ruach däremot kan beteckna individuella andliga varelser, som lögnens ande, en betydelse som neshama inte har.

    I skapelsen är det endast människan som explicit får neshama men neshama kan också användas för djur om dessa följer människornas lott. Att djur kan ha ruach är obestridd. Uppsatsens analys visar att det finns tydliga tecken på att neshama bär på en association till antingen skapelsen eller till syndafloden, en association som ruach inte har. Dessutom visar uppsatsens analys att det finns indikationer att Jobs bok står i dialog med Jesajaboken. Och slutligen finns det ett kiastiskt mönster i användningen av ruach i Psaltaren som indikerar att psalm 77 och psalm 78 kan vara de centrala psalmerna i Psaltaren.

    Purpose/Aim: The purpose of this study is to understand the meaning of global responsibility and toxicwaste control. The Basel Convention is the UN's international regulations on the import, export andtransport of hazardous waste. According to the Basel Convention, the export of electronic waste todeveloping countries is fully legal if the recipient country has given approval in writing. Is there a linkbetween toxic colonialism, global responsibility, justice and human rights?Material/Method: A qualitative case study of what delegates from three African countries think abouttoxic colonialism and global responsibility.Main results: The essay gives an explanation of the concept of toxic colonialism in relation to the BaselConvention and the Ban Amendment, from three African UN delegates, furthermore an analysis of theimportance it can have on global responsibility, justice and views on human rights.The essay results show that the Ban Amendment of the Basel Convention is in line with Rawl'sdifference principle and the principle of freedom and would contribute to increased justice on electronicwaste coding if the amendment goes through and is used in symbiosis with human rights: UDHRArticle 25 and ICESCR Article 12.1-2.

    Denna studie syftar till att undersöka hur församlingsaktiva unga vuxna, med olika etnisk och religiös bakgrund, upplever delaktighet i några församlingar inom Equmeniakyrkan. Med unga vuxna avses informanter i åldern 16 till 26 år. Undersökningen bygger på tre semistrukturerade fokusgruppssamtal med sammanlagt sexton informanter. Studien undersöker vilka faktorer som enligt informanterna främjar respektive motverkar delaktighet samt hur eventuella skillnader gestaltas bland informanterna beroende på religiös bakgrund. I intervjuerna framkom nio faktorer som främjar respektive motverkar delaktighet. Dessa är följande: att bli sedd, att känna människor i sin egen ålder, frekvent deltagande och eget engagemang, den egna viljan och det egna bidraget, att ha något att samlas kring, ledarskapet, vi och dom, ålder samt praktiska hinder. Resultatet har analyserats med hjälp av Giddens (Furseth och Repstad, 2005) begrepp aktör och struktur, Beckmans (2011) syn på integrationens problem samt Laves och Wengers (1991) teori om lärande. Studien resulterar i slutsatsen att det är svårt att säga om de studerade unga vuxnas delaktighet i församlingsgemenskapen är en självklarhet eller ett hänsynstagande gentemot församlingens rådande struktur. Det framkommer också att det inte går att finna några djupgående skillnader i upplevelsen av delaktighet beroende på religiös bakgrund.

    The Race to the Bottom: -A Minor Field Study of H&M’s CSR in practice2019Independent thesis Advanced level (degree of Master (Two Years)), 20 poäng / 30 hpOppgave
    Abstract [en]

    CSR has become a tool for global corporations to justify their outsourcing practices in other countries. Despite these CSR policies, reports reveal that labor rights violations are common in these supply chains, and not at least in the garment industry. The purpose of this study is therefore to explore how a global clothing company’s CSR policy on labor rights is working on the ground and which factors that influence its implementation. Interviews with factory workers and experts on the topic have taken place in one of India’s largest garment hubs. The findings are based on thematical analysis and the analysis suggests that the global brand (H&M) could improve the situation by taking certain actions though several external factors also have an affect. The responsibility for poor labor conditions needs to be divided between multiple actors who all have a duty to act within their spheres of influence. The study concludes that the underlying problem of economic exploitation must be brought to an end through increased cooperation between global companies.

    On July 1st 2018, a new law entered Sweden that would hopefully will lead to a better justice process regarding sexual offenses. This law was given the name consent

    law, which states that sex should be voluntary for the parties who are involved in the sexual acts. If not, the offender will be charged with rape.

    The majority of convictions for rape have easily led to the perpetrator being released from the charges. This indicates that something is not right and it’s not wrong with the evidence, the parties or persons working with the cases, but it is something that is defective in the law that has been found before. The previous laws, the Swedish Committee has considered that some terms are outdated for use in the current law.

    The previous laws did not agree with ECHR articles and since Sweden has ratified it, the national laws needed to be comprehensive.

    Through the course of the essay, we will go through various factors that have led to the current legislation, what resistance it has received and what criticism has it received when it came into force? It will be described what the law looks like and what application difficulties it may have.

    The purpose of the new law is to strengthen the sexual integrity of the victim and criminalize the perpetrator's behavior and negligence, which will be included in the thesis. Negligence is a new crime that came in connection with the new law. The law is designed to change the image of the ideal victim and put more focus on the perpetrator's actions to change the society's image of what rape is and hopefully more people will gain more knowledge, which will make big changes in the long run.

    Purity practices during the first century ce were widespread in Judaea and Galilee as part of everyday life and not limited to concerns relating to the temple cult. Developments in key water rites were partly triggered by concepts of graded impurity, to which an understanding of defilement via food also belonged. Certain rabbinic characteristics represent later developments and cannot be assumed for the time of Jesus. Hand impurity did not originate as a rabbinic decree to protect tĕrûmâ, and accusations against Pharisees for setting aside Scripture in favour of their own traditions did not originate with the historical Jesus, but suggest later polemics. Jesus’ stance on purity is perhaps better characterized as prophetic than halakic.

    This essay interacts with E.P. Sanders’s work on purity, building on some of his insights, while disagreeing on other points. Sanders’s appeal to historical imagination and common sense is discussed and problematized. The essay deals at length with issues such as the expulsion, isolation, and integration of various impurity bearers, and the emergence of additional water rites to mitigate impurities and prevent unnecessary contamination. The evidence under discussion includes Hebrew Bible, Dead Sea texts, Philo, Josephus, New Testament, and rabbinic literature.

    In the evolution of human beings as a successful social species, emotions have played a crucial role. This article focuses on the role of empathy for moral discernment, and especially on its role for an expanding altruism. Although a cultural construct, morality rests on emotional underpinnings which have ensured the survival of humankind. Some of these mechanisms are illustrated by a discussion of select biblical and Second Temple period Jewish texts, including texts from the Covenant Code, Deuteronomy, the Holiness Code, Proverbs, Genesis, and ben Sira. Special attention is given to definitions of altruism, the role of kin, and potentials for expanding empathy beyond assumed limits.

    This chapter examines the role of fear in the Pentateuchal legal collections. Fear of foreigners is conspicuous in laws regulating relationships with other peoples. Fear of divine punishment is frequently employed as a deterrent in motivating obedience. Fear of demonic or supernatural powers is implicit in certain rituals, not least in some that effect purification or atonement. This is not a study of the semantics of fear, but of the emotional role that fear seems to play within and behind the texts that are discussed. I note how fear both counteracts and interacts with other emotions, particularly empathy and disgust. I also relate my analysis to recent discussions about the interrelationship, dating, and social contexts of various Pentateuchal legal collections.

    Emotions in Biblical Law: A Cognitive Science Approach2011Bok (Fagfellevurdert)
    Abstract [en]

    This study pioneers the use of insights from cognitive sciences, such as evolutionary biology, neuroscience, and developmental psychology, as heuristic tools for interpreting ancient texts. The approach could be described as ‘psycho-biological’. The focus is on emotions in the various Pentateuchal legal collections. Kazen discusses the role of disgust, empathy, fear, and a sense of justice, for particular moral and ritual issues: purity and holiness; humanitarian concern for vulnerable categories; ethnocentrism and xenophobia; divine punishment and demonic threat; revenge, compensation, and ransom (kofer), together with removal (kipper) rites.

     The book consists of two main parts, framed by an introductory chapter and a concluding discussion. In the first part, Kazen explores cognitive foundations, including biological and neuroscientific underpinnings for basic affects, and the role of culture in shaping both conventional morality and ritual behaviour. Four particular emotions are then outlined. In the second part, these insights from cognitive science are applied in analyses of particular texts. After an overview of the Pentateuchal legal collections, each of the four emotions is dealt with in a separate chapter. Kazen continuously relates a cognitive science approach to more traditional source and redaction critical analysis, regarding them as complementary.

     As a result, the Pentateuchal legal collections are seen as emotional texts, expressing strong affects ­–  which influences our understanding of the character of Israelite ‘law’. Kazen suggests that interaction and conflict between various emotions can explain discrepancies and tensions between humanitarian concerns and ethnocentrism, and between empathy and justice. He also demonstrates that viewing emotions as common denominators contains a potential for solving some difficult and long-standing conundrums. He argues that a focus on the human embodied experience rather than on theological convictions and theoretical ideas may avoid some interpretative dead ends and open up new avenues for understanding ancient texts.

    Abstract [en]

    In this volume of collected articles and papers on impurity and purification in early Judaism, Kazen focuses primarily on questions of the impurity of discharges and the practice of hand-washing before meals. Kazen uses both literary and historical methods, as well as approaches based on cognitive science; the analysis covers texts from the Pentateuch, Qumran, the New Testament, and some Jewish Hellenistic authors.

    Some chapters are based on unpublished papers, and others have been recently published in various journals; two are based on material and arguments similar to a couple of forthcoming articles for volumes that will not always be easily found by potential readers.     What did Jesus think about Jewish practice regarding impurity? How did he relate to the inner-Jewish debates of his day concerning ritual purity and impurity? Did he discard the impurity concept altogether, or was it an obvious and natural part of his Jewish faith and life? Did he advocate another or different type of purity?

    Ritual or cultic purity was paramount in Jewish society and life during the Second Temple period, and differences in purity halakhah were one of the factors that distinguished various movements. Therefore, considering purity is crucial in any attempt to interpret the historical Jesus within his contemporary context. In keeping with this goal, Thomas Kazen discusses the historical Jesus alongside what we know of Jewish purity halakhah of his time and explains Jesus’ attitude toward impurity. Kazen balances the work of New Testament scholars on Judaism and legal matters by incorporating the historical Jesus studies of Jewish scholars, seeking to engage students of the historical Jesus with the primary materials relating to legal matters.

    Die urchristliche Ethik scheint mit ihren radikalen Forderungen den Menschen zu überfordern und gilt deshalb oft als Widerspruch zur Natur des Menschen. Diese Spannung wird durch moderne soziobiologische Thesen vom »egoistischen Gen« noch erhöht. Der Aufsatz zeigt: Viele naturwissenschaftliche Befunde sprechen für einen kooperativen Charakter nicht nur unserer Gene, sondern auch des Verhaltens höher entwickelter sozialer Tiere wie der Primaten. Menschliches und urchristliches Ethos können daran anknüpfen. Der Aufsatz weist nach, dass wir im Bild des barmherzigen Jesus im MkEv wie in der Ethik der Feindesliebe und des Gewaltverzicht in der Logienquelle eine Balance zwischen Selbsterhaltung und Nächstenorientierung finden. Auch die radikal altruistischen Gebote zur Vergebungsbereitschaft sind nicht gegen die Natur des Menschen gerichtet, sondern Weiterführung eines psycho-biologischen Erbes, ohne dass damit einer naturalistischen Begründung der Ethik das Wort geredet wird.

    Ritual purity was a major goal of cultic activities in the Mediterranean world, but in a number of contexts, purity was also considered a desirable condition regardless of culticparticipation. This chapter discusses the concept of purity and purification from phenomenological,linguistic, and ritual perspectives. Attention is given to the variegated use of purity terminology and to the use of cognitive metaphor and conceptual blending theories to understand and explain the broad and common usage of purity-related language in various domains. The chapter surveys and analyses a limited selection of purification rites from Egypt, Mesopotamia, Persia, Israel, Greece, and Rome. This is done both with a view to historical development, influence, and interaction, and with the help of theorizing on ritual efficacy and social effects of purity codes. Particular attention is given to purifications with water, especially in Second Temple Judaism, as these are crucial to the further development of water rites in emerging Christianity.
