    Fältstudiens syfte har varit att analysera och beskriva jämställdhets effekter på den unga generationen i dagens Rwanda. Min uppsats utfördes med en kvalitativ ansats där intervjuer har varit centrala som metod för att samla in mitt material och data. Jag har intervjuat unga vuxna kvinnor som är entreprenör eller i ledare position. Mitt resultat erhålls genom deras berättelser och upplevelser om jämställdheten i Rwanda.

    Rwanda har haft en stor representation av kvinnor i parlamentet vilket har i sin tur påverkat dessa unga kvinnor. Genom mina intervjuer har jag kommit fram till att Kvinnor i Rwanda tar mer plats som aldrig förr. Sammanfattningsvis har Rwanda gjort en stor skillnad för deras kvinnor. Den stora representationen av kvinnor i höga positioner har haft en bra inverkan på nästa generation och har inspirerat dem att drömma stort. Även om Rwanda har kommit långt när det gäller jämställdhet, utmaningar finns fortfarande och hela arbetet är inte gjort.

    Polisvåld mot afroamerikaner är ett stort problem i USA. Våldet är ett tydligt rasistiskt uttryckgentemot en specifik grupp i samhället som utsätts oproportionerligt, vilket innebär att derasrättigheter inskränks. Syftet med studien är att undersöka vilka faktorer som ligger till grund förpolisvåldet mot afroamerikaner i USA samt hur våldet påverkar deras rättigheter. Fokus i dennastudie ligger på två teorier som hävdar att det är olika psykologiska och politiska faktorer, samtrasistiska strukturer som ligger till grund för polisvåldet.Polisvåld är ingenting som endast påverkar enstaka individer, utan har en indirekt/direkt påverkanpå alla afroamerikaner. Detta innebär att även de personer som inte utsätts för fysiskt våld kanpåverkas på ett psykiskt sätt, vilket har en stor påverkan på hälsan.

    Seven long years of conflict in Syria with humanitarian catastrophe as consequence.The UN and the blocked Security Council, with the inability to address the deteriorating political andhumanitarian situation in Syria, actualizes the former Secretary-General Kofi Annan's words beforethe General Assembly in 2000:"... if humanitarian intervention is, indeed, an unacceptable assault on sovereignty, how should werespond to a Rwanda, to a Srebrenica - to gross and systematic violations of human rights thataffect every prescription of our common humanity?"From the Cold War until today, the UN system has failed to live up to the high expectations basedon the fundamental principles of the Charter and international law, which can be attributed to theimbalance between the General Assembly and the Security Council, as well as within the Councilbetween the five permanent members with individual veto and the chosen six.The question is not new. The tension in power balance and decision-making in the UN has existedsince the organization's formation. Interestingly in this context, the resolution Uniting for Peace,which was adopted in 1950, has as its starting point the unrestricted power of veto in relation to theGeneral Assembly's responsibility for peace and security.The resolutions Responsibility to Protect and Uniting for Peace become important and necessaryfor the understanding of the conflict in Syria, but also for a reform work motivated by humanitarianlaw. The meaning of the concepts of sovereignty, veto and erga omnes is therefore decisive in thebalance between de lege lata and de lege ferenda, with can be clarified by de lege interpretata.This essay will try to make the connection between these concepts more intelligible.

    Abstract [en]

    This thesis investigates how three high schools based in Stockholm organize their sex education. Do the schools meet the guidelines and policies for sex education or in which way do they not? The study is based on interviews with school staff and is analyzed through a new institutional theoretical perspective. According to the Swedish National Agency for Education, sex education overbridge various subjects; concepts like sexuality, equality, sex and relations are expressed in several high school curriculums. The Swedish National Agency for Education further explain that all teachers are affected by these questions, since it is related to the schools basic principles and values. The main result shows that the quality of sex education is dependent on the commitment from teachers, headmasters and students. Together they create certain norms, values and atmospheres which makes sex education to a very big challenge and sometimes a success.

    Abstract [en]

    1994 in Cairo United Nations Population and Development Fund held a conference where the attending 179 nations agreed that Sexual and reproductive health is a human right. Everyone is entitled to this right without distinction.

     

    This thesis investigates what covenants, declarations, policies, strategies and national law say about sexual and reproductive rights for men, specifically men in Sweden.

     

    The thesis aims to enlighten the reader about men’s situation in a welfare state where discriminatory structures in society is reproducing gender stereotypes in a country that is one of the most gender equal countries in the world.

     

    The general lack of common knowledge and subsequent lacking education in the matter is abundantly clear when browsing documents issued by official sources throughout the world. While Europe and its countries have begun to examine and call attention to this neglected subject, progress is still slow and could be hazardous to men’s sexual and reproductive health.

    The thesis concludes with an argument that Sweden have a discriminatory structure built in society that discriminate men and their right to sexual and reproductive health according to Discrimination Act 2008:567 by practices that appear to be neutral but can affect men in a negative way.

    Abstract [en]

    Purpose/Aim: The purpose of this study is to understand the meaning of global responsibility and toxic waste control. The Basel Convention is the UN's international regulations on the import, export and transport of hazardous waste. According to the Basel Convention, the export of electronic waste to developing countries is fully legal if the recipient country has given approval in writing. Is there a link between toxic colonialism, global responsibility, justice and human rights? Material/Method: A qualitative case study of what delegates from three African countries think about toxic colonialism and global responsibility. Main results: The essay gives an explanation of the concept of toxic colonialism in relation to the Basel Convention and the Ban Amendment, from three African UN delegates, furthermore an analysis of the importance it can have on global responsibility, justice and views on human rights. The essay results show that the Ban Amendment of the Basel Convention is in line with Rawl's difference principle and the principle of freedom and would contribute to increased justice on electronic waste coding if the amendment goes through and is used in symbiosis with human rights: UDHR Article 25 and ICESCR Article 12.1-2.

    Under 2017 påbörjades arbetet med att ta fram en Albansk handlingsplan för genomförandet av UNSCR 1325. Arbetet utmynnade i framtagandet av ett utkast som fastställdes i maj 2017 med målet om att anta slutgiltig version under 2018. Denna studie ska undersöka vilka förutsättningar den albanska handlingsplanen har för att lyckas och identifiera eventuella riskområden där implementationen riskerar att stöta på problem. För att uppfylla studiens syfte kommer en innehållsanalys göras av utkastets innehåll. Innehållsanalysen utgår från två uppsättningar av faktorer: de generella rekommendationerna som har sin grund i tidigare dragna erfarenheter om vad som utgör en framgångsrik handlingsplan, och de landspecifika rekommendationerna som tagits fram för Albanien utifrån den nationella kontexten. Resultatet av innehållsanalysen visar att handlingsplanen i viss mån följer det tidigare dragna erfarenheterna på området, dock med några tydliga brister. Studien presenterar tre riskområden där implementationen av handlingsplanen riskerar att stöta på problem. Avslutningsvis lyfts tio kompletterande rekommendationer inför antagandet av den slutgiltiga albanska handlingsplanen.

    Abstract [en]

    This study intends to concretize the concept of ”human dignity”, as well as see to its role inpolitics, and what consequences it has on juridical implementation. The discussion deals withthe importance of citizenship in Sweden. The purpose of the study is to focus onundocumented immigrants, their conditions and what implications a lack of citizenship has onthe group in question – ergo which connection actually exists between human dignity andcitizenship. Using the research questions it is discussed whether the concept of ”humandignity” is able to concretize, as well as if it possible to determine an ethical duty towardsundocumented immigrants based on the principle of human dignity.The essay is based on a social constructivist theory which, alongside a criticaldiscourse analysis in accordance with Faircloughs three-dimensional model, aims to theorise awell-discussed and established concept as well as power relations in society, and how acondition as an undocumented immigrant creates a new form of powerlessness. The methodproblematises the importance of citizenship for the experience of having human dignity.With this as the basis of the essay the result mainly shows the meaning of theconcept of ”human dignity” from ethical, political and legal perspectives, as well as therelation between the concept and citizenship. Thereafter the essay examines citizenship,partially from a general perspective but with its main focus on Sweden. Undocumentedimmigration serves as a counterpart to citizenship, which is concretised through an evaluationof the conditions of undocumented immigrants in Sweden at present. The analysis thatfollows aims to show that human rights are not the only fundamental thing for experiencingan intrinsic value, hence the discussion must go further, by showing that human dignity canserve as an adequate starting point to ensure a fundamental protection of individuals. This dueto the fact that the meaning of the concept goes further than claiming rights, and therebyshedding light to an additional nuance of the meaning of being human.3The conclusions that follow shows the problematics that the essay raises, butmoreover the possible areas for change or improvement that comes with the increasedresonance of the concept, as well as its established importance.

    Denna uppsats ämnar till att belysa problematiken och erfarenheterna kring etnisk diskriminering på arbetsmarknaden i Sverige. Genom samhällsvetenskapliga metoder har författaren undersökt sambandet mellan afrofobi och etnisk diskriminering på arbetsmarknaden, för att förstå orsakerna bakom högskoleutbildade afrosvenskars svårighet att etablera sig på den svenska arbetsmarknaden.Enkätundersökningar och intervjuer är metoder som använts i studien för att få empirisk material och avgörande narrativ om de olika orsakerna bakom afrosvenskars svårigheter med att komma in i arbetsmarknaden. Studien finner att det finns strukturella praktiker i arbetslivet som missgynnar personer med annan etnicitet än svensk. Undersökningen har genom intersektionellt maktanalys tittat närmare på etniskmaktordning för att studera relationerna mellan afrofobi, rasism och diskriminering. Historiebruk i Svenskkontext har i undersökningen visat sig vara en av de grundläggande orsakerna till uppkomsten av afrofobiska värderingar. Detta eftersom historiska ideologier och värderingar kopplat till rasbiologi, har bidragit till att reproducera och upprätthålla ett systematiskt hierarkiskt rangordning av underordning och överordning av människor utifrån hudfärg.1Studiens empiri visar att hudfärg och utseende är markörer för afrosvenskars utsatthet för rasistiskt motiverad diskriminering på arbetsmarknaden. Diskrimineringslagens snäva jurisdiktion och bristande rättstillämpning har missgynnat afrosvenskars möjligheter till att utkräva sina rättigheter på lika villkor, särskilt då begreppet etnicitet som diskrimineringsgrund inte fångar essensen i de rasbiologiska dimensionerna av rasism som påverkar afrosvenskars arbetsliv och tillgång till arbetsmarknaden. Trots att utbildning och vistelsetid i Sverige anges som viktiga framgångsfaktorer för individens chanser att få ett jobb i Sverige. Uppsatsen har funnit att högskoleutbildade afrosvenskar som är både födda i Sverige eller bott i Sverige länge har svårigheter med att få anställningar som motsvara deras utbildningsnivå och kompetens.

    Abstract [en]

    This essay aim to concern the regulations regarding asylum, foremost in the European Union and partly in an international context. After having a course about human rights in a European perspective I decided that I wanted to know more about the right to asylum, and therefore the regulations regarding asylum in a European judicial context as well as in an international approach. The three main question formulations are: 1. How are the overall EU legal frameworks as regards asylum law constructed? 2. What does the international principle of Non-Refoulement (not sending back refugees who risks being subject to inhuman punishment) implicate, which is sometimes referred to within asylum law at a EU level? 3. What is the situation as things stand in the field of asylum and migration? The purpose is to carry out an investigation of the right to asylum, as it is applicable in the judicial field. Furthermore, the aim is to carry out a comprehensive investigation of right regarding asylum order to further limiting the investigation somewhat with relevant regulations as well as legal principles in the area. Forward the purpose is to, partially study how the major regulations in the area of asylum law are able to be subject for comparison, but also to see how they can correlate. The aim is therefore to highlight these general, but crucial regulations that exists within the field of asylum mainly at a EU level and a little lesser internationally, in order to carry out an analytical comparison between them. The method for the essay entails an interpretation of the regulations by means of grounds of legal dogma and thereinafter with a comparative method. The result of the essay reveals that the European regulations regarding asylum is immensely inclusive containing a broad spectrum with everything from the right to asylum, criterias and mechanisms for administration of asylum applications, the best interest of the child to the rights which are destined to accrue to those who seeks asylum. The result also demonstrates that the international regulations as well as the European regulations provides for the rights which are destined to accrue to those who seeks asylum. The result also demonstrates that the international principle of Non Refoulement fully aim to protect those in need of protection of their lives or freedom to return to areas where this can be adventured. Likewise the result demonstrates that the regulations in these area both can be compared as well as they can be placed in relation to each other because of their correlation. The analysis of the essay, as well as its conclusion directs that the regulations are able to be put in a tighter context than it at first seems like. Additionally the essay detects that the European regulations, particularly those in stages of revise would be very helped by more influence from the international regulations, for example The Convention Relating to the Status of Refugees.

    This thesis studies the arguments for and against the removal of the word race from the Swedish Discrimination Law. Questions on race creeds in the society, rationalities and use of the word Race and its meaning linger in all spheres and are inescapable. One of the reasons could be the brutality carried in the word race and yet it remains to be part of the international vocabulary. Human beings are protected from Racial violations by International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and in it there is use of the word Race. Normative theory is used to analyse the Arguments from debates by antiracists and other materials to find the rationality in or without the word race in law. Do anti-racists halt racification, with or without using the word race in the Swedish law? This is the research question. The results indicate that the anti-racists do not halt racification, with or without using the word race in the Swedish law. This thesis is a call to illegalise racification and have clear description in the law on matters of racism. This thesis purposes to add onto the bank of an anti-racist arguments. It advocates for a halt of racification on human beings as a necessity for resolving racism.

    The aim of this thesis has emphasised on justice within the regulation constructed by The International Association of Athletics Federations (IAAF) concerning the eligibility for the female classification (athletes with Difference of Sex Development). Different arguments in IAAF:s regulation has been examined throughout a philosophical analysis to examine the validity of the regulation. The IAAF:s regulation validity is examined through the capabilities approach, which aims to promote individual justice of an individual and what the individual can become to her fullest. The other theory of justice originates from utilitarianism which is a type of justice that aims to bring the most fortune to the greatest amount of people. IAAF:s regulation is a governing tool which controls participation of female athletes in the elite level sport in races at international competitions. The women who get affected by its implementation are women who suffer from DSD (Disorder of Sex Development). The regulation requests that women with DSD, who develop higher amount of testosterone than the average woman, must undergo medication to participate in international competitions in different races. The effect of the medication results in the deterioration of their natural physiological health. IAAF considers it necessary since some women with DSD has an advantage in comparison to the average female athletes in the same race events. Throughout the capabilities approach this may seem as an unjust type of regulation for women with DSD. The theory of utilitarianism may see it as justice for the majority of female athletes. When applying these two types of justice, the capabilities approach and utilitarianism, the result will differ. The sports organisation IAAF has also been compared to other sports organisations. The comparison lies within what sport aims to be for the athlete. Before beginning with the analysis, the history of different control mechanism of the female athletes’ bodies will be presented to show the reader the complexity that lies in the female category of elite sports level.

    Abstract [en]

    The purpose of this paper was to examine and analyze Jomshof's argument in "Interpellationdebate 2017/18: 434 prayer call", where he proposed that freedom of religion be restricted byadopting a Swedish ban on Islamic prayer calls. In this work, a normative qualitative textanalysis has been used to investigate why Jomshof gives this proposal and how he does it. Ihave investigated this by examining the debate itself, but also by placing Jomshof's views intoa broader context of society and party ideology. Results from my analysis show that the centralviews the debater bases his proposal on is that the legal situation allows the realization of theproposal, that Swedish democracy is threatened, and that Swedish secularization must bepreserved. My analysis results also show that Jomshof's discourse is xenophobic and has racistundertones and that Jomshof wants to create an image of the existence of hierarchies amongpeople. What my analysys also showed was that negative consequences on individual andcommunity levels could occur if Jomshof's proposal was made law. Even if his opinionsexpress, and the way how he expresses them, could have negative consequences.

    Abstract [en]

    The main purpose of this study is to investigate how the corruption in the capital city (Kinshasa) of Democratic Republic of Congo (hereafter Congo) affects the inhabitants of the country, how common corruption is in Congo and how the people living in the country suffer from corruption. The secondary purpose of the paper was to investigate the consequences of corruption for those living in the country.The argumentation is analyzed by a semi-qualitative method using a questionnaire with quantitative and qualitative (open) questions answered by residents in the capital city of Congo. Kinshasa is a city characterized by great contrasts. In the city of Kinshasa there are areas with luxury residential neighborhoods, business areas and several universities, but also large and rapidly growing areas where poor people live. Residents from these two different areas of Kinshasa have been asked.The primary data analysis showed that the participants living in the poorer areas, to a greater extent than those living in the prosperous areas, find it common for corruption in Kinshasa to occur. They also argue that society is overcoming the problems of corruption in Kinshasa and that they suffer from corruption in Kinshasa to a greater extent than those living in the prosperous areas. The results of the survey also show that participants from both groups experience that corruption in common in the everyday life and that society oversees with the problems of corruption in Kinshasa. They find that corruption is something that belongs to everyday life, both in the working life and in the everyday life.. They also believe that they are having difficulties in getting their fundamental rights satisfied due to corruption.The conclusions that can be drawn from the survey are that the results are consistent with the situation in Congo described today. The people of Congo are still very vulnerable to the country's situation and widespread corruption. There is no well-functioning system, and those who have a higher position in society use daily corrupt methods to govern society. Civil society in the country is very weak and needs support, especially with regard to civil and human rights. The underlying causes of human rights violations are the country's widespread corruption

    Despite internal regulations, policy documents, statements, training, reporting mechanisms

    and international treaties accountability is perceived as inadequate when it comes to

    peacekeepers and sexual exploitation and abuse. This study will be based on a normative

    oriented jurisprudence and will use general international principles for reviewing the flaws.

    There are relatively robust regulations on how peacekeepers are expected to meet their

    standards of conduct but there simultaneously exists a legal vacuum when it comes to

    accountability. This study will to try to create an overlap in hope to further implement

    existing policy document.

    This thesis examines national name changes in terms of democratic and participatory rights. The research is divided into two sections; one compiles the information on several historic and contemporary name changes and analyses the common traits, the other investigates the eSwatini name change through case study interviews. The thesis is theory building on national name changes and settles on a conclusion on name changes being reasoned by either pragmatic sentiments or in terms of collective identity and that the processes of such name changes can be either democratic, organic, or undemocratic.

    Abstract [en]

    In this thesis the objective has been to identify differences in judgements between female and male offenders in legal cases about rape against children in Swedish courts.

    Female offenders are often seen as victims or mentally ill by judicial courts/institutions. By analyzing the cases from a theoretic perspective that gender is constructed by victimization the thesis will investigate how the offenders motivate their act. The thesis has investigated cases from 3 angles; the relationship with the child, the sexual act and their explanations to the committed crime/acts. There are some indications that construction of sex is identifiable.

    The relationship with the plaintiff in the cases is assumed from the feelings the child has towards the male offender, and when the offender is a woman it is assumed from her feelings and not the relationship with the child. Judgements with male offenders is more detailed with the sexual act and therefore also much more explained in the documents from the court. The female offender is often described as a vulnerable, manipulated or victimized and therefore given reason for not taking responsibilities for their acts. This is often used by the lawyer who represents the female offender.

    Abstract [en]

    This essay examines how the children of the Finnish Winter War were treated in the process. It focuses on three questions which are about the children’s’ situation and responsibility in the war. It also examines to what extent the UN Convention on the Rights of the Child as a tool can interpret what risks the children's situation put them in. These questions are being answered through an interview with a Finnish war child and a literature study.    The interview is reinforced by stories from other children who were repositioned during the war and also from those who were adopted to Sweden. The Convention on the Rights of the Child is used as the theory for understanding the children's situation. It is a tool to describe what needs children have and their needs to have a stable childhood. The essay finds that many children were exposed to events that affected how much time they had to be children and they were forced to take on a role of responsibility in their families. The situation can therefore clearly be said as not optimal for them. Many were forced to grow up too early because of this and were not allowed to participate in decisions or to consider their own feelings. A lot of them ended up falling behind in school and sources at the time were concerned that it could have consequences for their development which is also considered in this essay.
